Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between moskalow.catering UG (represented by Paul Moskalow, Eichendorffstraße 3, 40474 Düsseldorf) and its customers, in the version valid at the time the contract is concluded.

2. Offer and Conclusion of Contract

Our offers are non-binding and subject to change. A contract is concluded only upon written order confirmation or by performance of the order. Amendments and collateral agreements require written form.

3. Services and Delivery Terms

The agreed services comprise food, beverages, rental equipment as well as personnel and logistics. All food is prepared in compliance with the HACCP Regulation. Deliveries are made at the agreed times. Delays due to force majeure do not give rise to any claim for damages.

4. Prices and Terms of Payment

All prices are net prices, plus statutory VAT, unless stated otherwise. Upon placing the order, an advance payment of 80% of the expected gross total becomes due. The remaining balance must be settled in full, without deduction, no later than 5 working days after the end of the event. In the event of default of payment, we reserve the right to charge default interest at the statutory rate.

5. Cancellation by the Customer

In the event of cancellation by the customer, the following flat-rate charges apply:

• up to 30 days before the event: 20% of the order value
• 29–14 days before the event: 50% of the order value
• 13–7 days before the event: 80%
• from 6 days before the event: 100%

Services already rendered (e.g. planning, ordered goods) are always charged in full. Cancellation free of charge is only possible with written confirmation.

6. Withdrawal by the Provider

Moskalow Catering is entitled to withdraw from the contract if:

• the agreed advance payment is not received in time,
• unforeseeable circumstances make the provision of the services impossible (e.g. illness, force majeure),
• the event violates applicable law or our business interests.

7. Liability

We are liable only in cases of gross negligence or intent. We accept no liability for allergic reactions or intolerances if we have not received written notice thereof. We assume no responsibility for items and food brought along by the customer. The customer is fully liable for any damage to rented equipment caused by the customer or by the customer's guests.

8. Warranty / Complaints

Obvious defects must be reported immediately upon delivery or performance of the service. Later complaints cannot be considered. In the case of justified complaints, we reserve the right to remedy the defect or provide a reasonable replacement delivery.

9. Data Protection

The processing of personal data takes place exclusively for the purpose of contract performance and in accordance with our Privacy Policy.

10. Final Provisions

The place of performance and jurisdiction is, to the extent permitted by law, the registered office of moskalow.catering UG. These Terms and Conditions are governed exclusively by German law. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
